Portrait Image Release Contract

We understand that there a SO many great options out there for photography so we're blessed you've chosen us to fill those empty photo frames! Please know, we never sell images to third parties but we do use many of the images we capture throughout our website and social media accounts. Because of this, please complete the form below and be sure to mark the appropriate boxes regarding privacy & usage by our business. 


Final Consent


FULL RIGHTS RELEASE: I hereby authorize Manor Studios 1848 (a division of Rustic Manor 1848 LLC) to reproduce and display my images in marketing, including but not limited to: social media, print and on the company's website.


I understand that my session fee includes the time and talent of a photographer, professional editing of images as determined by the photographer along with an online, password protected gallery for viewing, sharing, purchasing of prints and products. Additional prints, digital images, and albums are available for purchase through Manor Studios 1848 (a division of Rustic Manor 1848 LLC). 


I understand that the photographer(s) will photograph me and/or persons at the session and all persons shall be deemed to have consented to the use of their name, image, or likeness by the photographer(s) for the duration of the Event. I shall indemnify and defend Rustic Manor 1848 from and against any claims that any of those participating in the session may assert against Rustic Manor 1848 LLC arising from, or related to, the use of any name, image, or likeness of those persons by the photographer(s). I understand that those participating in the session will be positioned in many poses in order to capture the best image the photographer(s) believes possible. 


I understand that I will be given printing rights of all final images.


If there are any costs/fees associated with the location I, the client, has chosen for my session, I, the client, will be responsible for those fees. If the session taking place at "Rustic Manor 1848" there is no additional fee. I agree to discuss this with my assigned photographer at minimum 48hrs prior to the session. Creative fees cover travel within 30 minutes of Hartland, WI area. Any location outside of these limits will be subject to an additional charge of $.60/mile as part of this agreement. 


If an illness or situation prevents a photo session from taking place, I, the Client, may reschedule the session at least 24 hours prior to their shoot without penalty. Should I fail to give 24 hours notice, decide to completely cancel the shoot or no-show to a scheduled session, the session fee is forfeited and will not be refunded. Rustic Manor 1848 LLC reserves the right to reschedule sessions due to photographer illness, weather, equipment malfunction, or other circumstances beyond their control. Re-shoots are determined at the discretion of the photographer. Re-shoots and refunds will not be given for poor choices of clothing, make-up, hair or weather-related issues, or by not following the recommendations of the photographer. 


I understand that I am not to alter the images in any way other than to crop for social media purposes. Filters and re-edits are not permitted. I understand that I will not be held liable for the misuse/miscredit of the photographer's work by others once the images have been placed online in digital format by me, as long as I have done my part in properly crediting the photographer and any/all involved parties (wardrobe stylists, photographers, makeup artists, hair stylists, venue, jewelers, etc, etc). 


I understand that there is no guaranteed minimum for the number of images I will provided from each session. The number of edited images provided is at the sole digression of Rustic Manor 1848 LLC. I understand that I do not have right to and will not be given RAW unedited images under any circumstances. 


I understand that Rustic Manor 1848 retains all copyrights to all images created during my session. A print release may be purchased with digital files to print portraits for personal use up to designated size listed on print release. The print release does not allow publication of my portraits (i.e. entering in contests), selling or altering images without the company’s written permission. It is illegal to copy, scan, download, print, share, alter, or otherwise steal any image created by a Manor Studios 1848 photographer during my session. This applies to "sneak peek" images, images posted in an online proofing gallery, blog, Facebook and any other form of social media, or hard copy images. I understand that if I steal images via any method listed above, or any other method, I will be invoiced for the cost of EACH digital image I have stolen, at the company's current price per digital file. 


After six (6) months, all images will be purged from the company hard-drive, except as needed for promotional purposes, to be determined by Rustic Manor 1848 LLC at the company's sole discretion. Rustic Manor 1848 LLC is not responsible for loss or damage to the digital files due to circumstances beyond the company's control. Rustic Manor 1848 LLC is not responsible for the damage of portraits, prints and/or albums after delivery to me, the client, including damage caused during transit by US mail. I assume all responsibility for the safety of all these items upon receipt. 


I hereby release and discharge Manor Studios 1848 (a division of Rustic Manor 1848 LLC) from any and all claims and demands ensuing from or in connection with the use of my photographs, including any and all claims for libel and invasion of privacy.


I, the undersigned Client, hereby warrant that I am competent to contract in my own name. I confirm that I have read the herein agreement prior to its execution and I am fully familiar with the contents thereof. This agreement shall be binding upon completion of the form below.

If your images are being used as a gift, please tell us after what date do we have your permission to begin using your images.
